AN ACT relating to motor vehicles; eliminating the requirement that the driver and passenger of a motorcycle being driven on a highway wear protective headgear; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1Ê Section 1. NRS 486.231 is hereby amended to read as follows:

1-2Ê 486.231 1. The Department shall adopt standards for

1-3Ê [protective headgear and] protective glasses, goggles or face shields

1-4Ê to be worn by the drivers and passengers of motorcycles and

1-5Ê transparent windscreens for motorcycles.

1-6Ê 2. Except as otherwise provided in this section, when any

1-7Ê motorcycle[, except a trimobile or moped,] is being driven on a

1-8Ê highway, the driver and passenger shall wear [protective headgear

1-9Ê securely fastened on the head and] protective glasses, goggles or

1-10Ê face shields meeting those standards. [Drivers and passengers of

1-11Ê trimobiles shall wear protective glasses, goggles or face shields

1-12Ê which meet those standards.]

1-13Ê 3. When a motorcycle [or a trimobile] is equipped with a

1-14Ê transparent windscreen meeting those standards, the driver and

1-15Ê passenger are not required to wear protective glasses, goggles or

1-16Ê face shields.

2-1Ê 4. When a motorcycle is being driven in a parade authorized by

2-2Ê a local authority, the driver and passenger are not required to wear

2-3Ê the protective devices provided for in this section.

2-4Ê 5. When a three-wheel motorcycle[,] on which the driver and

2-5Ê passengers ride within an enclosed cab[,] is being driven on a

2-6Ê highway, the driver and passengers are not required to wear the

2-7Ê protective devices required by this section.

2-8Ê Sec. 2. NRS 486.241 is hereby amended to read as follows:

2-9Ê 486.241 1. A person shall not sell, offer for sale or distribute

2-10Ê any protective [headgear,] glasses, goggles or face shields for use by

2-11Ê any drivers or passengers of motorcycles or transparent windscreens

2-12Ê for motorcycles unless the equipment is of a type and specification

2-13Ê meeting the standards therefor adopted by the Department.

2-14Ê 2. The provisions of this section do not prohibit the sale of

2-15Ê protective [headgear,] glasses, goggles or face shields which comply

2-16Ê with the rules and regulations adopted by the United States

2-17Ê Department of Transportation.
